It already is the Trial of The Century ... for me!!!

Tomorrow (January 20th, 2015 at 1:30pm) will be the 4th day of the trial, and the "prosecution" or "plaintiff" is still presenting their case. They had appealed to the judge to "mix and match" between two sections of the law (one for civil harassment restraining orders and the other for workplace violence restraining orders). The two laws are almost identical and repeat about 90% of the exact same content. This makes them independent (it's not as if one of them refers to the other as a "baseline"). So their differences should be uniquely applied to each section. Robin Marien filed a workplace violence restraining order, but his lawyer was trying to argue to have some aspects of the other section applied. I'm not guilty of either section anyway, but the judge ruled (correctly in my opinion) that they needed to prove what was in the section that they filed.

So the case goes on. It's been 3 days already and Robin Marien's lawyer says he still has more witnesses to call. It seems to me that they're trying to accomplish 2 things: (1) bury me with legal costs, and (2) wear down our witnesses to keep them from being there to testify.

I have to admit that both strategies may be having some success. My lawyer has (fairly) asked for more money, and a number of witnesses have (fairly) stated that they can't just keep coming to court day after day. Robin, on the other hand, has made millions of dollars from his free lease at Torrey, and many of the people he brings to testify are his own employees - who don't have to ask their boss for time off ... day after day after day.

Despite all that, I am hopeful that justice will prevail.
Me too. Or failing that, we can hope for a really ugly backlash to do some significant damage to USHGA.

An excessively rapid ascent is likely to cause an airplane to go into an aerodynamic stall. In 2009, an Air France Airbus A330 disappeared over the Atlantic Ocean in bad weather while flying from Rio de Janeiro to Paris. Investigators determined from the jet's black boxes that it began a steep climb and then went into a stall from which the pilots were unable to recover.
If only these pilots had understood how completely harmless stalls are.

I also like that this discussion emphasizes that breaking a weak link is something that can be practiced - just like we practice stalls - so we understand how to handle them and to not be afraid of them. I had a terrifying stall experience with my instructor when I was learning to fly airplanes back in the 70s. For a long time I feared getting close to stall. As long as I feared stalls, I was not spending much time getting comfortable with them, and that didn't make me a better pilot. So there's a lot to be said for safely learning to handle the inevitable rather than trying to come up with some way to avoid the inevitable.

While the offending posts clearly violated our Terms of Service, it's not clear (at least to me) that they violated the Oregon law that wingspan33 quoted. I haven't read the entire law, but of the parts quoted, this section seems the most likely violation:
(B) Publicly insulting such other person by abusive words . . . in a manner intended and likely to provoke a violent response . . .
The violation is not clear because of the phrase "in a manner intended and likely to provoke a violent response". That section uses the word "and" which means that the insults must be both intended and likely to provoke a violent response. The reliance on intention seems to make that law difficult to apply. I doubt that whoever made those posts was looking to provoke a violent response from Sara - especially without giving their real names. Were they intending for Sara to punch her computer? But this is clearly a gray area, and if anyone sees a post that they feel is in violation of any law, please flag it with the "Report" button. Thanks.

Finally, it's also not clear (again, to me) how the Oregon law relates to the first amendment of the U.S. Constitution:
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
There's a slippery slope when we attempt to regulate what people can and cannot say...

This release won't accidently open by hitting your base tube, if you connect it to your chest tabs. It is small and easily stored. If you can't store it during flight, it is the most aerodynamic one available. The bridle is thin and gets out of your way right away. Easily stored. Also creates less drag if you don't put it away. Much stronger than your weaklink. I change bridles about once a year after about fifty tows. I switch the ends after twenty five tows.

I had asked Regional Director Candidate Bill Helliwell a couple of very reasonable questions about his stance on open voting by the USHPA Board of Directors. Davis removed my posts from the topic, banned me, and eventually deleted the questions I had asked. He didn't make an announcement that he was doing it. I was just silently ... gone. I also lost access to all of my personal messages that I had exchanged with other pilots on his forum.

So Davis won't come to this forum because too many of us ... know what he's done.

That was really funny, but would have been more accurate if, instead of Fox News, he'd said NPR.
But he DIDN'T say it. And if he had it wouldn't have been funny because it wouldn't have been accurate or made a dust particle's worth of sense. Comedy tends to work best when it's operating on a platform of truth and intelligence. (There aren't a whole lot of people in hang gliding who can make me laugh and most of the ones who can are here on Kite Strings.)

If there are any successful stupid pigfucker comedy individuals or shows on par with Tom Lehrer, George Carlin, Monty Python, Jon Stewart, Stephen Colbert, Tina Fey regularly using NPR as a punchline I sure haven't heard about them. Maybe you could clue me in.

First off, we all...

...know that burning fossil fuel emits carbon dioxide. And we all know that most of the fossil fuel that we're burning comes from the ground and would not likely be burning without human intervention.
Give us some examples of where that DOESN'T apply. Try to limit their absurdity as much as possible.
So there's no doubt that we're putting more carbon dioxide into the air than was there just before mankind learned to play with fire.
Mankind learned how to play with fire hundreds of thousands of years ago but we were burning renewable sticks so our effect on the percentage of CO2 in the atmosphere was essentially ZERO. We didn't start digging up and burning fossil fuels on any scale until the start of the Industrial Revolution a couple hundred or so years ago.
But that doesn't mean that we're putting more carbon dioxide into the air than was ever there before. After all, where do we get the fossil fuels to burn? Don't they come from fossils? So prior to the fossilization process, wasn't all that carbon dioxide in the atmosphere anyway?
Yeah, let's go with that line of "THINKING". 2.4 billion years ago before the cyanobacteria got photosynthesis figured out there was zilch in the way of atmospheric oxygen. So it should be no big fuckin' deal if we all just breathe nitrogen for a couple billion years until that gets worked out again.
My main point is that our atmosphere is like a down tube (I'll bet you didn't see that coming).

A downtube can suffer two kinds of deformation: elastic and inelastic. An elastic deformation is a minor flexing that leaves the tube unaffected when you remove the force.
However, if this flexing occurs as a result of compression load in flight your best outcome becomes floating down under silk.
In other words, it bounces back to its original condition. An inelastic deformation is a major flexing that causes permanent damage to the metal (including breakage). A down tube won't bounce back from an inelastic deformation. In some cases it can be forced back, but that's yet another inelastic deformation and each of them further weakens the metal.

So the real question about global warming isn't so much whether we're bending the down tube - we know we're bending it. The question is whether we're bending it to the point of breaking.
How's our atmospheric CO2 level gonna bounce back to it's original condition when we take the stress off? If we stop burning coal, oil, natural gas this afternoon where's the excess CO2 we've already released gonna go?
It's hard for me to know if that's the case except to point to the likelihood that most (if not all) of the carbon dioxide we're putting into the atmosphere comes from previously living matter that had likely gotten it from the atmosphere. If that's the case (please let me know if it's not), then until we literally run out of things to burn, we're likely still in the elastic range of that system (since our current state came from that prior state).
And then all we gotta do is watch a few "Friends" reruns while we're waiting for the hundreds of millions of years to elapse to get all that nasty CO2 fossilized. Total fucking idiocy.
There, now both sides can flee the US Hawks because I've demonstrated that I both believe that we're experiencing global warming (a clearly flaming leftist) and I'm simultaneously in denial of its consequences (an obvious right-wing neocon).

There are many ways we can work together to benefit the sport. Neither of us will get everything that we want from that arrangement, but we'll each get more than we're getting now.

As far as returning you to the US Hawks forum, I don't see that happening as long as you remain an unrepentant child molester. That's both a moral and legal judgement on my part and I take sole responsibility for that decision. When the US Hawks has a functioning Board of Directors, you're welcome to appeal that decision with them, but I don't see me changing my mind. If you want to "go to war" with me over that non-hang-gliding issue, then that's your call. I tend to fire back when fired upon, and I don't want to hear any complaining if things get personal in those exchanges. Again, you get to make the decisions. I'm just letting you know what lies ahead down both of those paths.

The olive branch is extended. I hope you'll accept it.

This points out why I struggle with Tad. He really has a lot of good knowledge about this sport, and he's a potentially fantastic asset to any organization. But when he's on the wrong side of an issue he becomes worse than useless because he's so convinced that he's right. I believe this is compounded by self-esteem issues with regard to people who he feels have disrespected him. So I don't really know how to handle the situation.

There will be many problems that crop up as the US Hawks grows. I think it's important that we - as a community - work together to handle them in the best way that we can. There are lots of things to learn from Tad's case. I am not convinced that I did the best thing...
